Hit and Run Driver Faces Criminal Charges

Cobb County Police have arrested the driver and passenger of a Porsche sought for the fatal hit-and-run accident that claimed the life of Emanuel R. Mitchell, 31, earlier this month.

Mitchell died after being struck by two vehicles on I-75 in the southbound lanes near Windy Hill Road on August 20th. He died at the scene. The second driver was not charged in the crash.

Brandon Weston, 32, of Smyrna and Pamela Kay Rice, 41, of East Cobb were booked on multiple charges and are being held without bond. Weston is charged with 2nd degree vehicular homicide, hit-and-run, tampering with evidence and failure to maintain a lane. He was also charged with several other charges, said a police spokesman.

Rice was charged with 2nd degree vehicular homicide, tampering with evidence and being party to a hit-and-run.

A break in the case came when someone saw a suspicious vehicle in a body shop in Alabaster, Ala. That suspicion lead to several online searches that lead to articles about police seeking a Porsche 944 involved in the hit-and-run crash. The person called local authorities who contacted Cobb County Police.

Cobb investigators were able to match vehicle parts involved in the accident to a Porsche that was found at the body shop.

The police had been searching for the driver for 10 days.

Hit and Run Driver Sought For Deadly Motorcycle Accident

Cobb County Police are looking for the driver and vehicle involved in a fatal hit-and-run motorcycle accident on I-75 Saturday that claimed the life of Emanuel R. Mitchell, 31, of Norcross.

The vehicle involved in the accident is a gray or silver 1986 to 1991 model year Porsche 944 [view photo]. Police say the vehicle may have damage to its left front from the collision.

Mitchell was thrown from his Kawasaki Vulcan motorcycle Saturday evening when the driver of the Porsche moved into his lane causing a collision, police said. A second driver, Sonni Smith, 23, of Atlanta, told police her vehicle struck Mitchell after the driver of the Porsche made initial contact with his motorcycle. He died at the scene, according to a police spokeswoman.

Smith will not be charged.

Evidence recovered at the crash scene helped investigators to determine the make of the car with the assistance of the manufacturer.

Police are still searching for the driver of the Porsche. Anyone who has any information regarding the accident is urged to contact Cobb County police at 770-499-3987.

Detroit Fatal Motorcycle Accident

A 40 year old biker suffered fatal injuries in a Detroit motorcycle accident last night.  Police report that Rochelle Ringo was travelling on Gratiot when a van turned into her path and caused the accident.  The driver left the scene of this hit and run accident.  Detroit police are following up leads to find the driver.

It am always amazed at the indifference of a person who could be involved in such an accident and leave the scene without knowing if the accident victim will survive.  I certainly hope that the driver is caught and brought to justice.  My thoughts go out to this woman’s family.

The surviving family may have a number of legal rights to pursue, even though the negligent driver has not yet been identified.  This could include claims for funeral expenses, lost income, and the loss of this woman’s companionship.  There are deadlines for filing these claims and it is important to hire a Michigan motorcycle accident lawyer as soon as possible to look into all possible claims.

Ionia County Motorcycle Accident

Police in Ionia County, Michigan are looking for a driver of a green Dodge Caravan that injured a motorcyclist last week.  Richard Clark of Belding, Michigan suffered injuries when the negligent motorist disregarded a stop sign and caused the accident.  The driver fled and left the scene of the accident.  The Ionia County Sheriff’s Department is trying to locate the driver.

The injured biker may have several possible legal claims, even though the driver has not been indentified.  Depending on the type of coverage that Mr. Clark had on his bike, he may be entitled to Michigan No-Fault Insurance benefits and even possibly an uninsured motorists claim for his injuries.  He should contact an experienced Michigan motorcycle accident lawyer to discuss his case.

Jackson Hit and Run Motorcycle Accident

A Jackson hit and run motorcycle accident has left the biker injured.  The accident occurred at the intersection of Styles Road and Meridian Road on December 24, 2008.  The motorcyclist was stopped at a stop sign when a truck turned into the bike.  The truck driver fled the scene while the biker was taken to Allegiance Health Center and then UM Hospital for treatment.  He was believed to be seriously injured.  Police are still investigating the accident and trying to identify the hit and run driver.

I am very sorry this accident occurred, especially since it was during the holidays.  I hope this man is able to recover completely from his injuries.

Because the motorcyclist was injured in an accident that involved a truck, the Michigan No Fault Act applies.  The man will be able to file a claim for No Fault insurance benefits.  No Fault insurance will pay for this man’s medical expenses including his current hospital bills and any reasonable and necessary follow-up treatment.  No Fault insurance will also pay for a portion of his lost wages, household replacement services, and attendant care benefits.  More information about all of these benefits is available in the Insurance Information section of this website.

In addition to his claim for No Fault insurance, this man may be able to file a lawsuit for additional damages.  For instance, No Fault insurance only pays for lost wages for up to three years after the accident.  If this man was disabled from work for more than that, he could collect lost earnings in a lawsuit.  Or, he could collect non-economic damages like pain and suffering.  Michigan law only allows people with very serious injuries to file a lawsuit after an accident like this, so this man should consult with a lawyer to determine if he has the option of filing a lawsuit.
