MCL 691.1402 says in pertinent part “. . . each Governmental agency having jurisdiction over highways, shall maintain the highway in reasonable repair so that it is reasonably safe and convenient for public travel. A person who sustains bodily injury or damage to his or her property by reason of failure of a Governmental agency to keep a highway under its jurisdiction and reasonable repair and in condition reasonably safe and fit for travel, must recover the damages suffered by him or her from the Governmental agency.”

To assert this type of claim, the injured biker is required by law to provide written notice to the government agency responsible for maintaining the roadway where the injury occurred.   The written notice must be served within 120 days of the injury, with very few exceptions, or the claim will be forever barred.  The notice must include the date of the injury, the precise location of the injury, the nature of the defect, and the names of any known witnesses.

Southwest Michigan Motorcycle Accident Is Fatal

There was a story in the paper today about a tragic Southwest Michigan motorcycle accident. The accident took place on Wednesday, July 7th, around 1:oo p.m on Barren Lake Road in Howard Township. According to the Cass County police, two motorcycles were hit by a vehicle driven by a 39-year-old man. Two people were killed, and one suffer serious injuries.

I am very sorry to hear about this tragic motorcycle accident. My deepeset condolensces go out the family and friends of the deceased victims and I hope the injured victim has a fast recovery without any permanent damages.

Roseville Motorcycle Accident

A 45-year-old man was injured in a Roseville motorcycle accident on May 6th. The biker rode his motorcycle down Gratiot when a minivan, driven by a 75-year-old-man, turned in front of him causing him to crash into the side. 

The biker apparently had serious injuries to the head and chest and was taken to area hospitals.  His prognosis is unknown at this time.  My wishes for a prompt and speedy recovery go out to him.
